More Lawsuits Against Mining Law

 On Tuesday March 31st, representatives of the Community Water Systems of the rural parishes of Tarqui and Victoria del Portete together with several other communities from the province of Azuay, presented a lawsuit in the Constitutional Court seeking to have the mining law passed in January declared unconstitutional.
This becomes the second legal action of this sort since the Confederation of Indigenous Nationalities of Ecuador (CONAIE) presented a similar lawsuit on March 17th.
Members of the Community Water Systems of Azuay argue that the mining law violates various rights established in the new constitution, such as:
The right to prior consultation, rights of nature, the right to water and precedence for its use, recognizing that water is also considered strategic national patrimony, as well as the right to live in a healthy and ecologically-balanced environment, the right to live well (“buen vivir”), and the right to good nutrition. They add that the law
violates international conventions, including among others the International Labour Organization's Convention 169 and the United Nations Declaration on the Rights of Indigenous Peoples.
The plaintiffs specifically refer to a gold mining project that will irreparably affect high wetlands in Azuay known as Kimsacocha (or “Three Lagoons” from their name in Kichwa). They name President of the Republic Rafael Correa and President of the Legislative Assembly Fernando Cordero in the lawsuit for having expedited and approved the mining law.
This new case demonstrates ongoing and growing opposition to the recently approved mining law by communities affected by large scale mining projects.
The President of the Constitutional Court has committed to act justly, and is being observed nationally and internationally to ensure that he fulfills his word in accordance with the principles advanced in the new constitution, widely recognized beyond our borders.

MÁS DEMANDAS CONTRA LA LEY MINERA
Este Martes 31 de Marzo representantes de los Sistemas Comunitarios de
Agua de las parroquias Tarqui y Victoria del Portete, y varias
comunidades de la provincia del Azuay, presentaron ante la Corte
Constitucional una demanda de inconstitucionalidad por la aprobación
en Enero de este año de la Ley Minera. Esta acción se suma a la
demanda de inconstitucionalidad que presentó la Confederación de
Nacionalidades Indígenas del Ecuador CONAIE el pasado 17 de Marzo.
Los usuarios de los Sistemas de Agua del Azuay argumentan que con esta
Ley Minera se han violado varios derechos establecidos por la nueva
Constitución, tales como:
El derecho a la consulta, los de la naturaleza, el derecho humano al
agua y la prelación en su uso, así como el agua en su calidad de
patrimonio nacional estratégico del estado, el derecho a vivir en un
medio ambiente sano y ecológicamente equilibrado, el derecho al buen
vivir, el derecho que garantiza la alimentación. También se violentan
Convenios Internacionales como el 169 de la OIT, la Declaración de
Naciones Unidas de los Derechos de los Pueblos Indígenas entre otros.
Los demanadantes hacen referencia al proyecto de explotación de oro
que afectará irremediablemenete al Cerro Kimsacocha (Tres Lagunas) en
Azuay. Las autoridades demandadas son el presidente Rafael Correa
cabeza del Ejecutivo, y Fernando Cordero, presidente de la Asamblea
Legislativa, por ser quienes expidieron y sancionaron la ley de
Minería.
Esta nueva demanda evidencia el proceso sostenido y creciente de
oposición que mantienen las comunidades afectadas por proyectos
mineros de gran escala a la reciente Ley Minera aprobada, sobre la que
ya se viene dando una lluvia de acciones legales.
El compromiso expresado por el presidente de la Corte Constitucional
de actuar con justicia pone la mirada nacional e internacional sobre
el cumplimiento de su palabra, basado en los principios de avanzada
que rigen la nueva Constitución y que le han dado enorme
reconocimiento fuera del país.
