The CRD highlights that it would require detailed reports and development permits from WFP before the approval of any subdivision. Given WFP's current deadline for approval of April 23, 2009, it is unlikely that WFP will be able to fulfill the CRD's needs.
WFP Court Challenge of CRD Bylaws:
Many concerned citizens are waiting with baited breath to hear what the BC Supreme Court judge will decide on Western Forest Products' (WFP)
challenge of the CRD bylaws restricting subdivisions in the Juan De Fuca(JDF) Electoral Area.
WFP and members of the BC Landowners Association are challenging the decision-making structure of the CRD which led to the progressive re-zoning of previous forest lands in the JDF. The hearings took place on October 15 and 16, 2008.
If the CRD loses, the bylaw amendments made on April 23, 2008 will be struck down, and WFP will have more time to have their subdivisions approved. However, the CRD may challenge such a decision and take it to the Court of Appeal.
